Paycheck-Protection-Program-Frequenty-Asked-Questions

To all independent practitioners:

San Juan IPA has been monitoring the CARES Act, and in particular the Paycheck Protection Program.  The IPA CEO and CFO participated on a conference call arranged by the NMMS, and have gleaned some facts as well as have some materials for you, should you be interested:

– Although this is an SBA loan, the banks are actually the ones funding the loans up to the limits of their liquidity.

– Because the banks are funding the loans, many banks have stopped processing them due to liquidity concerns.

– The banks are currently inundated with applications, so if you have not applied and intend to you should ASAP.

– Although there is talk of a “Round 2” of funding, banks are searching for a secondary market for these loans.

– The loans are FDIC insured with a $10M limit.

– Providers must show they have been “adversely, financially affected” by the COVID-19 pandemic.  There is little to no guidance as to what
the definition of “adversely, financially affected” means.

– Loans must be used in this ratio: 75% for payroll (including taxes and healthcare benefits); 25% for mortgage, utilities, etc.

– The first 8 weeks of the loan is forgivable; if you have to pay the loan back, it is amortized over 18 months at 1% interest.

– See the attached forms and email link below for application and other information.

Alert: Individual Posing as OCR Investigator

It has come to OCR’s attention that an individual posing as an OCR Investigator has contacted HIPAA covered entities in an attempt to obtain protected health information (PHI).  The individual identifies themselves on the telephone as an OCR investigator, but does not provide an OCR complaint transaction number or any other verifiable information relating to an OCR investigation.

HIPAA covered entities and business associates should alert their workforce members, and can take action to verify that someone is an OCR investigator by asking for the investigator’s email address, which will end in @hhs.gov, and asking for a confirming email from the OCR investigator’s hhs.gov email address.  If organizations have additional questions or concerns, please send an email to: OCRMail@hhs.gov.

Suspected incidents of individuals posing as federal law enforcement should be reported to the Federal Bureau of Investigation (FBI).  The FBI issued a public service announcement about COVID-19 fraud schemes at:

https://www.ic3.gov/media/2020/200320.aspx.
